CAIR-CLEAN AIR INTERSTATE RULE

CAIR UPDATE
On December 23, 2008, the D.C. Circuit remanded without vacatur EPA's Clean Air Interstate Rule (CAIR). The state has been requested to work with the CAIR contact at the EPA Regional Office to determine requirements and this is ongoing. The CAIR NOx provisions are/will be in effect in 2009 for all applicable electrical generating units. Once all of the ramifications of the December 23, 2008 remand are understood the department will host a CAIR meeting in Baton Rouge for discussion.
 

CAIR will achieve substantial reductions of sulfur dioxide (SOx) and nitrogen oxides (NOx) emissions at electrical generating units using a cap-and-trade approach to help meet EPA's protective air quality standards for ozone and fine particles in the eastern United States.
