Manifest Regulation Changes - Bulletin February 20

The Louisiana Department of Environmental Quality (LDEQ) has adopted changes to the hazardous waste manifest regulations. Effective January 20, 2001, generators, designated facilities, and recyclers are no longer required to submit copies of the manifest to LDEQ. Due to the regulation changes in the Environmental Regulatory Code, Part V., LAC 33:V.1107.C., the Department will now use a five (5) part manifest form not an eight (8) part manifest form. The new five (5) part manifest form is on order and should be received in two (2) to three (3) months. Continue using the eight (8) part manifest until you deplete your supply (do not send copies 1, 6, or 7 to the Department).

Additional changes you should be aware of are:

§905.A.4. within 30 working days after the delivery, send a signed copy of the manifest to the generator (this was seven (7) working days in the past).

§907.B. Upon discovering a significant discrepancy, the owner or operator must attempt to reconcile the discrepancy with the waste generator or transporter (e.g., with telephone conversations). If the discrepancy is not resolved within 15 days after receiving the waste, the owner or operator must immediately submit to the Office of Environmental Services, Environmental Assistance Division a letter describing the discrepancy and attempts to reconcile it, and a copy of the manifest or shipping paper at issue
