CRIMINAL INVESTIGATION DIVISION
The Department of Environmental Quality has more than 160 field staff conducting inspections, responding to complaints or participating in field activity as part of their regular duty. These professionals are the eyes and ears of the department. By working as a team with the DEQ Criminal Investigation Division, the department is able to better complete its mission of protecting human health and the environment, while promoting economic development. Working together, all DEQ staff can help ensure a level playing field for all and guarantee that those who commitenvironmental crimes are dealt with appropriately.

WHAT IS CRIMINAL ACTIVITY
Criminal cases are usually selected based on if an activity causes significant environmental harm
or if there is intentional wrongdoing.

EXAMPLES OF SIGNIFICANT
ENVIRONMENTAL HARM
1. ACTUAL HARM THAT CAN BE DEMONSTRATED THAT HAS HARMFUL IMPACT ON HUMAN HEALTH OR THE ENVIRONMENT.
2. FAILURE TO REPORT AN ACTUAL DISCHARGE,
RELEASE OR EMISSION THAT HAS HARMFUL IMPACT
ON HUMAN HEALTH OR THE ENVIRONMENT.
3. A TREND OF ILLEGAL CONDUCT IN A PARTICULAR INDUSTRY.
EXAMPLES OF INTENTIONAL WRONGDOING
1. HISTORY OF REPEATED VIOLATIONS.
2. DELIBERATE MISCONDUCT.
3. CONCEALMENT OF MISCONDUCT OF FALSIFICATION OF RECORDS.
4. TAMPERING WITH MONITORING EQUIPMENT.
5. OPERATING WITHOUT A PERMIT OR OTHER REQUIRED DOCUMENTATION
