Important Legislative Acts

As leakage from underground storage tanks posed a threat to Louisiana’s groundwater, the Louisiana Legislature passed Act 767 on July 15, 1988, as a means of helping underground storage tank (hereinafter referred to as “UST”) owners, operators, or responsible parties (hereinafter referred to as “owners/owner”) meet the financial responsibility requirements set forth by the Environmental Protection Agency. Additionally Acts 336, §1, eff. June 16, 1995, and Revised Statute §2195 were passed establishing a state treasury trust fund to reimburse remediation costs for sites with eligible releases.

The Trust Fund is managed by the Department’s Financial Services Division, Trust Fund Management Section, and is designed to reimburse costs incurred during the rehabilitation and remediation of affected soils, groundwater and surface waters at motor fuel contaminated UST sites, provided these costs are necessary and appropriate. The Trust Fund reimburses only those costs which return the site to the use and occupancy in effect at the time the release occurred. It is the mission of the staff involved in processing the reimbursement requests to ensure that the integrity of

the Trust Fund is not jeopardized by the incorporation of inappropriate and excessive expenditures. Pre-approval of costs are required by statute (R.S. 30:2195.4.A.1).

 

Act 167 of the 2024 Legislative Session resulted in a number of changes to the statutes related to the Motor Fuel Trust Fund. The Secretary's response letter to MFTF Advisory Board, link provided below, describes the major modifications and the Department's implementation of the revised statutes.
