United States Reaches Agreement to Protect New Orleans Waterways and Lake Pontchartrain - September 29, 2020
Today, the U.S. Environmental Protection Agency (EPA) and the Department of Justice announced a settlement with the Churchill Downs Louisiana Horseracing Company LLC, d/b/a Fair Grounds Corporation (Fair Grounds) that will resolve years of Clean Water Act (CWA) violations at its New Orleans racetrack. Under the settlement, Fair Grounds will eliminate unauthorized discharges of manure, urine and process wastewater through operational changes and construction projects at an estimated cost of $5,600,000. The company also will pay a civil penalty of $2,790,000, the largest ever paid by a concentrated animal feeding operation in a CWA matter.

LDEQ Integrated Reports
The Integrated Report (IR) is the current form of biennial reporting of the status of Louisiana waters. The IR is made up of what was once called the 305(b) Water Quality Inventory Report and the 303(d) List of Impaired Waterbodies. One of the primary focuses of the IR is on the use of five categories and three subcategories to which waterbodies or waterbody/impairment combinations can be assigned. Categorization under IR guidance allows for a more focused approach to water quality management by clearly determining what actions are required to protect or improve individual waters of the state. The IR categories and definitions can be found at the link below. Other changes resulting from U.S. EPA's IR guidance can be found in the 2002 Water Quality Inventory, Executive Summary.

The U.S. Environmental Protection Agency publish the “Onsite Wastewater Treatment Systems Manual”. This document can be used to provides up-to-date information on onsite wastewater treatment system (OWTS) siting, design, installation, maintenance, and replacement. It reflects significant advances that the expert community has identified to help OWTSs become more cost-effective and environmentally protective, particularly in small suburban and rural areas. In addition to providing a wealth of technical information on a variety of traditional and new system designs, the manual promotes a performance-based approach to selecting and designing OWTSs. The goal of this site is assist to state and local agencies, watershed groups, nongovernmental organizations and others in developing effective communications materials related to nutrient pollution. Nutrient pollution can cause human health problems, fish kills, and algal blooms. The U.S. Environmental Protection Agency (EPA) wants to enlist the help of local groups in sharing information with the media and the public about the growing threats to our nation’s water resources from nutrient pollution and ways that the public can help make a difference. Making this important environmental issue relevant to one’s community and explaining how it affects local water resources (like your local lake, river, reservoir, etc.) will be critical for success.

Baton Rouge's 2008 8-hour ozone nonattainment area re-designated to attainment status - December 15, 2016
Today, the U.S. Environmental Protection Agency re-designated the Greater Baton Rouge Nonattainment Area (BRNA) to attainment for the 2008 8-hour ozone standard. The state of Louisiana submitted a request for EPA to re-designate the BRNA to attainment status and to approve a State Implementation Plan (SIP) revision containing a maintenance plan for the area. This is another milestone in Louisiana’s continuing effort to improve air quality.

Coastal Zone Management Act (CZMA)
The U.S. Congress recognized the importance of meeting the challenge of continued growth in the coastal zone by passing the Coastal Zone Management Act (CZMA) in 1972. The Act, administered by NOAA's Office of Ocean and Coastal Resource Management (OCRM), provides for management of the nation's coastal resources, including the Great Lakes, and balances economic development with environmental conservation; The CZMA outlines two national programs, the National Coastal Zone Management Program and the National Estuarine Research Reserve System. The 34 coastal programs aim to balance competing land and water issues in the coastal zone, while estuarine reserves serve as field laboratories to provide a greater understanding of estuaries and how humans impact them. The overall program objectives of CZMA remain balanced to "preserve, protect, develop, and where possible, to restore or enhance the resources of the nation's coastal zone."

Xplor Energy pleads guilty to felony Clean Water Act violation - November 20, 2014
U.S. Attorney Kenneth A. Polite announced that XPLOR Energy SPV-1, Inc. ("XPLOR"), an Oklahoma corporation residing in Southlake, Texas, pled guilty today to a one-count bill of information which charged the company with knowingly violating the Clean Water Act, Title 33, United States Code, Section 1319(c)(2)(A).
