Air Permits
Any source, including a temporary source, which emits or has the potential to emit any air contaminant (defined as particulate matter, dust, fumes, gas, mist, smoke, or vapor, or any combination thereof produced by process other than natural) requires an air permit.

Title V/Part 70 Operating Permits
This application should be completed when applying for a Part 70 (Title V) permit, including a general Title V permit, or a Title V permit modification. It should also be used to apply for a Prevention of Significant Deterioration (PSD) and/or Nonattainment New Source Review (NNSR) permit.

Application for Approval of Miscellaneous Permitting Actions
This application is primarily submitted in order to request approval for an activity for which a permit is not required, or to notify LDEQ of changes at the facility that are more administrative in nature. Examples of miscellaneous air permitting actions include, and are not limited to, requests for administrative amendments, authorizations to construct, changes of tank service, Emission Reduction Credit (ERC) certificates, exemptions to test, small source exemptions, withdrawals, and variances.

Acid Rain requirements apply to most fossil fuel-fired combustion devices (e.g., boilers) that serve a generator with a nameplate capacity greater than 25 MWe to produce electricity (i.e., power plants). Although LDEQ issues Acid Rain permits for EPA, EPA has retained delegation of the remainder of the program. Acts 586 and 779 of the 2006 Regular Legislative Session authorized the department to develop an expedited permitting program. The statutes allow interested applicants to reimburse the department for overtime costs incurred by DEQ employees that work overtime to expedite a permit, modification, license, registration or variance. These statutes also afford the department the opportunity to hire contractors to perform this work if deemed necessary.
All requests for expedited permit processing must be accompanied by the required form. Applicants for expedited permit processing should be aware that not all permitting activities are eligible. Approval of expedited permit processing requests are subject to, among other considerations, the availability of departmental resources. When a site undergoes a company name change, facility name change, and/or permit transfer associated with ownership and/or operator changes, a Notification of Change Form must be submitted in accordance with LAC 33:I.Chapter 19.

The U.S. Environmental Protection Agency (EPA) has delegated LDEQ the authority to implement and enforce certain New Source Performance Standards (NSPS) and National Emission Standards for Hazardous Air Pollutants (NESHAPs) promulgated by EPA at 40 CFR 60, 61, and 63. This delegation applies to both Part 70 and non-Part 70 sources. See 40 CFR 60.4(b)(T) & (e)(2), 61.04(b)(T) & (c)(6)(ii), and 63.99(a)(18).
